These terms apply when you use evergreenwebsites.ca or hire Evergreen Web Pros ("Evergreen", "we", "us") for websites, monthly plans or related services. If we both sign a separate written agreement, that agreement takes priority wherever the two differ.
Prices on our website are in Canadian dollars, plus applicable taxes. Your written quote sets out the work included and the final price. Quotes are valid for 30 days. We may change our monthly plan prices with at least 30 days' written notice.
Website packages include the number of revision rounds listed for that package. A revision round is one combined set of feedback on the work we've delivered. Additional rounds, new features or work outside the agreed scope are quoted before we start.
Monthly plans include the number of small changes listed for that plan. A small change is an update such as new text, a photo or a price that takes up to 30 minutes. Unused changes don't carry over to the next month, and larger work is quoted separately.
To keep your project on schedule, please provide content, feedback and approvals promptly. If a project is on hold for more than 60 days because we're waiting on you, we may close it, and restarting it may involve an additional fee. You confirm that you have the right to use anything you give us, and that your business information and website content are accurate and lawful.
You can cancel a monthly plan at any time with 30 days' written notice. Amounts already billed for the notice period aren't refunded, and any included hosting ends when the plan ends. Before then, we'll provide your site files on request if your account is paid in full.
You can cancel a website project at any time. The deposit is non-refundable once work has started, and you'll be billed for any completed work that exceeds it. Nothing in these terms limits refund rights you have under law.
Once your project is paid in full, you own the final website content and design we created for you. Your own content stays yours throughout. We keep ownership of our general tools, methods and reusable code, and you receive a permanent licence to use them as part of your website. Third-party software, fonts and images remain subject to their own licences.
We may show completed work in our portfolio and marketing. If you'd prefer that we don't, email us and we'll remove it.
Your website may rely on providers for things like hosting, domains, email, payments, booking or AI tools. They're responsible for their own services, and their outages, price changes or policy changes are outside our control.
We work to help customers find your business, but search engines decide their own rankings. We can't guarantee a particular ranking, amount of traffic or number of sales.
AI assistants can make mistakes. You're responsible for checking the information given to your assistant and for how it's used with your customers. Don't rely on it for legal, medical, financial or emergency advice.
Except where the law requires otherwise, our services are provided without any promise that they'll run uninterrupted or error-free. We'll fix defects in our own work that you report within 30 days of launch at no charge.
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us for the service involved in the 12 months before the claim arose.
You may not misuse this website, including by trying to disrupt it or gain unauthorized access. The content on this website belongs to Evergreen or is used with permission, and our client work belongs to its respective owners.
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there.
We may update these terms from time to time and will post any changes here. The version in effect when you accept a quote applies to that project.
